عفو عام عن المخالفين في الاقامات، ونظام
قانون الأجانب والاقامات (المعدل) في شمال_قبرص.
يمنح العفو للأجانب الذين حُكم عليهم لوجودهم في البلاد بشكل غير قانون، سيكون ساري المفعول لمدة 90 يومًا بين 6 نوفمبر 2022 و 3 فبراير 2023 (بما في ذلك كلا التاريخين).
أولئك الموجودون في قبرص الشمالية والأجانب المحكوم عليهم ؛ في غضون 90 يومًا من تاريخ نفاذ العفو ، سيكونوا قادرين على الاستفادة من العفو من خلال دفع مبلغ من المال يساوي الحد ألادنى للأجور، عبر الإنترنت ، من خلال زيارة الموقع الرسمي لوزارة الداخلية :
https://icisleri.gov.ct.tr/.
سيتمكن الأجانب الذين حُكم عليهم والذين هم في الخارج من الاستفادة من العفو عن طريق دفع حد أدنى إجمالي للأجور عند دخولهم البلاد ، بعد أن يتقدموا شخصيًا إلى قنصليات شمال قبرص التركية أو ممثلياتها في الخارج في غضون 90 يومًا من تاريخ بدء نفاذ القانون وبعد اكمال الفحص والموافقة اللازمة من قبل إدارة الاقامة.
ملاحظة: الأشخاص ، الذين استفادوا من عفو الهجرة ، بين 4 نوفمبر 2021 و 31 يناير 2022 مع قانون الأجانب والهجرة (المعدل) رقم. 18/2021 لا يمكنهم الاستفادة من عفو الهجرة هذا.
أ- الأشخاص الموجودين شمال قبرص:
الأشخاص الذين لم يغادرون البلاد على الرغم من انتهاء صلاحية تصاريح إقامتهم أو عملهم أو دراستهم الممنوحة لهم عند الدخول إلى شمال قبرص عليهم تقديم حد أدنى للأجور في غضون 10 أيام من تاريخ الموافقة التي حصلوا عليها من قبل مكتب الهجرة بعد تقديم طلب عبر الإنترنت .
الأشخاص الذين دخلوا بتأشيرة سياحية ولم يغادروا البلاد رغم انتهاء صلاحيتها ؛ يجب عليهم أن يدفعوا حدًا أدنى للأجور في غضون 10 أيام من تاريخ موافقة مكتب الهجرة بعد تقديم طلب عبر الإنترنت ،
الأشخاص الذين لم تم ترحيلهم ، لكن لديهم اقرار ترحيل بسبب الإقامة والعمل غير المصرح به ؛ يجب عليهم دفع حدًا أدنى للأجور في غضون 10 أيام من تاريخ موافقة مكتب الهجرة بعد تقديم طلب عبر الإنترنت ،
الأزواج ، والأطفال غير المتزوجين الذين تقل أعمارهم عن 25 عامًا ، والأطفال ذوي الإعاقة فوق سن 18 ؛ يجب على أزواج الأشخاص المحكوم عليهم التقدم بطلب إلى مكتب الهجرة في غضون 60 يومًا بعد العفو (سيتم إعفاؤهم من دفع العقوبة)
ب ـ الاشخاص الذين يعيشون في الخارج:
سيكونون قادرين على الاستفادة من العفو عن طريق دفع الحد الأدنى الإجمالي للأجور عند دخولهم البلاد ، بعد أن يتقدموا شخصيًا إلى قنصليات أو ممثليات الجمهورية التركية لشمال قبرص في الخارج في غضون 90 يومًا من تاريخ دخول القانون حيز التنفيذ ، وبعد الفحص اللازم وموافقة دائرة الهجرة.
يُعفى المستفيدون من العفو من إجراءات التصريح الأولية إذا تقدموا بطلب للحصول على تصريح عمل ضمن تصريح الزيارة لمدة 60 يومًا الممنوح لهم من قبل صاحب العمل. إذا لم يحصلوا على إذن قانوني في غضون 60 يومًا ، فعليهم مغادرة البلاد.
يمكن للأشخاص المتزوجين من مواطني جمهورية شمال قبرص التركية ويعيشون في الخارج ولكن تم تغريمهم ، الاستفادة من العفو عن طريق دفع الحد الأدنى الإجمالي للأجور وإظهار وثيقة تثبت الزواج عند دخول البلاد.
يمكن لأزواج الأشخاص الذين يعيشون في شمال قبرص مع تصريح الإقامة ، وإذن الطالب وتصريح العمل الذين يعيشون في الخارج وتم تغريمهم الاستفادة من العفو عن طريق دفع الحد الأدنى للأجور وإظهار وثيقة تثبت الزواج عند الدخول إلى بلد.
يمكن للأطفال غير المتزوجين (أقل من 25 عامًا) والأطفال ذوي الإعاقة (فوق سن 18) من الأشخاص الذين يعيشون في شمال قبرص مع تصريح الإقامة وتصريح الطالب وتصريح العمل الذين يعيشون في الخارج وتم تغريمهم الاستفادة من العفو بدفع الحد الأدنى للأجور وإظهار وثيقة تثبت أنهم معاقون وأنهم من أبناء الشخص عند دخولهم البلاد.
يمكن للأشخاص الذين تم ترحيلهم من البلاد بسبب الإقامة غير المصرح بها الاستفادة من العفو من خلال تقديم تقرير صالح بأنهم ليس لديهم أي مضايقات او حكم فيما يتعلق بالأمن القومي. من أجل الاستفادة من العفو ، يتعين عليهم دفع الحد الأدنى الإجمالي للأجور ، بالإضافة إلى ذلك ، يجب دفع نفقات النقل التي دفعتها الدولة أثناء ترحيلهم من خلال النظام عبر الإنترنت. كما سيتمكن الزوج والأطفال من الاستفادة من هذا العفو.
الأشخاص الذين تم ترحيلهم من البلاد بسبب الإقامة غير المصرح بها ، يجب أن يتقدموا شخصيًا إلى قنصليات أو ممثلي جمهورية شمال قبرص التركية في غضون 90 يومًا (من التاريخ الفعلي – 6 نوفمبر). بعد إجراء إدارة الهجرة الفحص والموافقة اللازمة ، سيتمكنون من الاستفادة من العفو عن طريق دفع حد أدنى للأجور عند دخولهم البلاد.

ENGLISH
The Foreigners and Immigration (Amendment) Law, which provides amnesty for foreigners who have been fined for being in the Turkish Republic of Northern Cyprus without permission and is known as Immigration Amnesty, will be valid for 90 days between 6th of November 2022 and 3rd of February 2023 (including both dates).
Foreigners, who are living in the Turkish Republic of Northern Cyprus and who have been fined, will be able to benefit from the amnesty by visiting the official website https://icisleri.gov.ct.tr/ and making an online payment (minimum wage).
Foreigners, who have been fined and living abroad, must personally apply to the TRNC Consulates or Representatives within 90 days (from the effectıve date- 6th of November). After the Immigration Department makes the necessary examination and approves, they will be able to benefit from the amnesty by paying a gross minimum wage when they enter the country.
NOTE: People, who benefited from the Immigration Amnesty, between 4 November 2021 and 31 January 2022 with the Foreigners and Immigration (Amendment) Law No. 18/2021 cannot benefit from this Immigration Amnesty.
A- PEOPLE WHO ARE IN THE TURKISH REPUBLIC OF NORTHERN CYPRUS.
a- People who do not leave the country even though their residence, work or student permits granted to them upon entry to the Turkish Republic of Northern Cyprus have expired; Providing a minimum wage payment within 10 days from the date of approval getting by the Immigration Office after making an online application,
b- People who entered to the country with a Tourist Visa and did not leave the country even though it expired; With the condition that making a minimum wage payment within 10 days from the date of approval of the Immigration Office after making an online application,
c-People who have not been deported but have deportation order because of working or living without taking permission; Provided that online minimum wage payment within 10 days from the date of approval of the Immigration Office after making an online application.
d-Spouses, children under the age of 25 (single), children with disabilities over the age of 18,of the beneficiaries of the current Amnesty; An application should be made to the Immigration Department within 60 days after the amnesty of the person, who has fine, is granted (They will be exempted from paying the penalty)
B-THOSE WHO HAVE BEEN LIVING ABROAD
Foreigners, who have been fined and living abroad, must personally apply to the TRNC Consulates or Representatives within 90 days (from the effectıve date- 6th of November). After the Immigration Department makes the necessary examination and approves, they will be able to benefit from the amnesty by paying a gross minimum wage when they enter the country.
a-The beneficiaries of the Amnesty are exempted from the preliminary permission if they apply for a work permit within the 60-day visitor permit granted to them by their employer. If they do not get legal permission within 60 days, they have to leave the country.
b-People, who are married to a TRNC Citizen and are living abroad but have been fined, can benefit from amnesty by paying a gross minimum wage and showing a document proving the marriage upon entry into the country.
c-Spouses of people with living in Turkish Republic of Northern Cyprus with the residency permission, student permission and work permission who are living abroad and have been fined can benefit from amnesty by paying minimum wage and showing a document proving the marriage upon entry into the country.
d-Single children (under the age of 25) and the children with disabilities (over the age of 18) of people with living in Turkish Republic of Northern Cyprus with the residency permission, student permission and work permission who are living abroad and have been fined can benefit from amnesty by paying minimum wage and showing a document proving that they are disabled and that they are a child of the person upon entry into the country.
e-People, who are deported from the country due to unauthorised residency, can benefit from the amnesty by providing a valid report that they do not have any inconvenience in terms of national security.
In order to get benefit from the amnesty, they need to pay gross minimum wage.Additionally, transportation expenses which was paid by the state duringtheir deport must be paid through the online system. Spouse and children will also be able to benefit from this amnesty.
f-People, who are deported from the country due to unauthorised residency, must personally apply to the TRNC Consulates or Representatives within 90 days (from the effectıve date- 6th of November).
